As a matter of fact, nobody should take the content found in this public domain too seriously as it is not designed to model any relations with reality. 2.3 We reserve the right to require that you change your username or use another email address. You are prohibited from using another person’s account or registration information for the Services without their permission.
2.4 You are responsible for all activity that occurs on your account registered with 3rd party platforms. You promise to immediately let us know if there is any unauthorized use of your account. You can delete your account at any time, either directly or through a request to us.
In other words: If you sign up for an account on the Services, you are responsible for all activity on your account. Be mindful about protecting your account and let us know immediately if you think there are any issues.
3.1 You are solely responsible for all of the content you contribute to the Services (“User Content”) and as between you and MemeSake, you own your User Content. You hereby do and shall grant us a non-exclusive, worldwide, perpetual, royalty-free, fully paid, transferable, sublicensable right to use, modify, reproduce, distribute, prepare derivative works of, display, perform and otherwise fully exploit such User Content (including all related intellectual property rights) in connection with the Services and our business.
3.2 You promise that you have all rights to grant such license to us without infringement or violation of any third party rights. If you contribute User Content through a public part of the Services, you acknowledge that such User Content will be accessible to other users. Please do not publicly post or submit any User Content that you do not want publicly accessible or viewable, or that you do not have rights to post.
In other words: You own all content you contribute to the Services, but you’re ok with MemeSake using it in connection with its Services. Public Information is public, so don’t include any private or sensitive information in any public part of the Services.
4.1 Each user account shall have provision for virtual coins named MemeCoin (MC) for use within the app only. These coins can be earned by getting engagement on your published content and through several other bounty programs. The Meme Coins will be stored in your user account and the value stored therein is non-transferable to any other user on the platform.
4.2 The MCs can be redeemed into cash by making requests through the app and can also be used at the marketplace developed by MemeSake which features several physical and virtual products. Although every product listed will have a separate set of terms and conditions that can be reviewed on each product page. However, when you make a purchase you are bound to those terms respectively with each product. As of now this currency is non transferable to other user accounts and the price can be updated at any time without prior notice. Currently the value of 1000 MC is 10 USD.
In other words: It has a virtual currency MC which can be earned by engagement on published content and other bounty programs. MCs can be redeemed into cash and can also be used at the marketplace within MemeSake.
(i) MemeSake shall through appropriate payment means transfer the MemeCoin value into real world currency in the value promised in the above section (1000MC=10USD)from their MemeSake user account to the bank account or any third party wallet of the user.
(ii) MemeSake holds the right to disallow any user from redeeming virtual currency if the user is found to be utilizing the user account against the Terms of Use or Community guidelines or any other appropriate law, regulations or rules issued by an appropriate governmental authority or by utilizing any unethical method by exploiting any flaw in the system.
5.1 We and our licensors own and retain all proprietary rights in the Services. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services.
5.2 The Services may contain copyrighted material (such as text, graphics, photographs, images, and illustrations), trademarks, and other proprietary information and materials of us and our licensors. Credit the Community: People work hard to make their posts, and we want to make sure they get their proper dues. Help us support the community by using MemeSake’s share tools to make sure that the original creator is getting credit for the work.
Sharing: Sharing is great. Please use MemeSake‘s share options, available on each MemeSake‘s individual page, for proper sharing on your blog or social media accounts. Before you use posts you find on MemeSake or anywhere else on the web, you‘ll want to make sure you‘re comfortable that your use complies with any laws applicable where you‘re located.
Terrorism and Extremism:You as a user must not post content encouraging or supporting the terrorist activity or terror groups. Support of any other dangerous activity will lead to MemeSake reporting such incidents to the appropriate authority.
Further, the platform cannot be used to further any terrorist or other related criminal activity. Using the platform for any such activity will lead to ban on the user, and the incident of such activity will be reported to the legal authorities.
Violence:We don’t mind posts that show fictional violence (in other words, pretend play where no one actually gets hurt), but if it’s real, then it’s not allowed. Any posts that portray real death, mutilation, gore, or assault are not permitted. Further, users are not allowed to publish or transmit any obscene material that causes Public Mischief or is of the nature of criminal intimidation.
Graphic, Obscene and Sexual Content:Users must not post any content which is sexual or pornographic and is obscene, or graphic on the MemeSake platform. Users must be aware that publishing or transmitting any such material is punishable in accordance with the provisions of the Indian Penal Code and the Information Technology Act, 2000. Sorry! In general, if it’s not something that you’d show your mom, don’t upload it on MemeSake.
Self-Harm:You can’t create, upload, or share anything that encourages or promotes self-harm. This includes activities or behavior related to suicide, self-mutilation, or eating disorders.
Animal Cruelty:Absolutely no post of animals being harmed or abused are permitted. Period.
Bullying, Stalking, Harassment, or Threats:You can’t create, upload, or share posts to bully, harass, or threaten another individual. Users must not publish or transmit any content which can amount to sexual harassment to other users.
Users are not allowed to make any remarks which are sexually explicit or contain sexual innuendoes directed at any specific individual. Users are not allowed to share any content which contains non-consensual nudity. Posting content of such nature may amount to legal actions in accordance with the provisions of the Indian Penal Code, which deals with Sexual Harassment or outraging the modesty of Women.
Hate Speech:Memes are meant for everyone, so we don’t allow any post that slander, demean, or belittle another group or person based upon their race, religion, gender, or sexual orientation. Those are a definite no.
Illegal Activity:Don’t create, upload, or share a post of illegal activity on MemeSake. You also can’t use MemeSake to engage in or promote illegal activity.
Private Information:You can’t upload or share posts that reveal any private or sensitive information about another person. This includes things such as addresses, phone numbers, passwords, and anything else that could be considered personal.
Misinformation or Fake News:We aim to combat the spread of misinformation on our Platform. Any content that spreads deliberate misinformation, disinformation, hoaxes or fake propaganda to mislead the users or the general public is not permitted. We prohibit posting content that exaggerates an existing piece of news by introducing non-factual elements into it.
Religiously offensive content:Users must not post any content which is offensive to the religious sentiments of others. Users are recommended to be respectful of the religious faiths, deities, customs, and practices of others and must not insinuate communal hatred.
Spam:Content which misleads users about its origin, displays or promotes false advertisements, fraudulent or misleading representations and security breaches fall under the ambit of spam. Such content, when posted for commercial gain, amounts to commercial spam. Spam interferes with the smooth functioning of the Platform and deters other users from sharing and connecting. It is important that the content you share is authentic and facilitates the creation of a safe and trusted environment for people to post on the Platform. Do not post the same content multiple times if it intends to annoy viewers or sell goods/services to promote spam, commercial or otherwise. Do not use artificial and manipulative means to generate traffic or increase followers, likes, views, comments and shares.
Intellectual Property Rights:Users must not violate any Intellectual Property Rights of anyone on the platform. Posting content on the Platform which is not original and is copied from an individual/organisation who owns the intellectual property rights in such content/works is not allowed. Any content which violates the intellectual property rights of third parties will be taken down, and strict action will be taken against users who are repeat defaulters. If you wish to reshare such content from within the Platform, kindly do not remove any attributions, watermarks and original captions that state the content's authentic source. In addition, please take the required permissions and give due credits to your fellow users or any other organisation/individual who own the intellectual property rights in such content by mentioning their name and the source. The platform takes any report of intellectual property violation seriously. It does not promote or host any content which may violate the applicable Indian Laws relating to Intellectual Property Rights.

Grievance Redressal MechanismThe users can complain through an email to the Grievance Redressal Officer to report any violation of the law on the MemeSake application or to claim a right provided to them by any Indian Law. The officer shall acknowledge the complaint in 24 hours, and the complaint shall be disposed of in 15 days, along with explaining the decision taken.
